TERMS AND CONDITIONS OF SALE and DELIVERY
Dear Customer,
We inform you that the general terms and conditions of sale set forth below, in compliance with current consumer protection regulations, indicate the terms and conditions for purchasing products you are interested in online from the MAGIC COOKER website (hereinafter referred to as the Seller) in a safe, easy, and convenient manner. We therefore invite you to read and accept them in order to proceed with your purchase.
I. SUBJECT
These general conditions of sale govern the sale of products marketed by the Seller to consumer users and to users acting for purposes related to business activity.
These general conditions are effective from the date of acceptance by the customer on the site, which constitutes acceptance pursuant to art. 1341 of the Civil Code.
The company reserves the right to modify these general conditions of sale at any time by posting them on the website.
The company excludes any contractual or extra-contractual liability for direct or indirect damages to persons and/or property caused by the non-acceptance, even partial, of an order.
II. PURCHASE METHODS
Products are purchased by accessing the site and registering. A description of each product containing its main features is available on the site. All information supporting purchases is intended as general information only.
It is understood that the image accompanying the product description may not be perfectly representative of its characteristics, but may differ in color, size, and accessory products shown in the figure.
Correct receipt of the order is confirmed by the Seller via an automatic email response, sent to the email address provided by the customer during registration. This confirmation message will contain an "order number" to be used for any communication with the company. The message will contain all the information entered by the customer, who undertakes to verify its accuracy and promptly communicate any corrections.
In the event of non-acceptance of the order, the seller guarantees timely communication to the customer.
DELIVERY TERMS
All orders paid for by 2:00 PM on a working day will be dispatched within the next 24-72 hours and delivered on working days only (excluding Saturdays, Sundays and public holidays).
Shipping times for Calabria, Basilicata, Sicily, Sardinia, and smaller islands or peripheral areas are approximately 48-72 hours.
Actual delivery date may vary depending on location.
Shipping will not be possible for orders with addresses located in remote areas.
Magic Cooker will deliver the ordered products to the address you indicated.
All delivery times listed are estimates based solely on item availability, normal order processing, and delivery times.
III. PAYMENT METHODS
All prices on the site are intended to be retail prices and, therefore, include VAT.
Prices may vary without notice and the only correct price is the one indicated at the time of order confirmation.
For certain products subject to price promotions, the seller reserves the right to accept orders by reducing the quantity, subject to prior communication and acceptance by the customer, failing which the order will be considered cancelled.
For purchases made by credit card, upon completion of the online transaction, the relevant banking institution will authorize the payment for the purchase amount only. The amount for any goods shipped, even partially, will be charged to the customer's credit card only upon delivery of the ordered goods to the courier.
For further information or support, you can contact the seller or the Customer Support team directly at the telephone number during the hours indicated. The cost of the call is 12 cents per minute from a landline and varies depending on the operator from a mobile phone.
PayPal
Payment for products purchased on the Site can be made via PayPal. Once the order is complete, the Customer is directed to the PayPal login page. The total amount of the order is charged to the PayPal account upon order confirmation.
Stripe (it is expected)
Stripe is a secure and simple system that allows us to offer our customers the option to pay with the most popular credit cards.
You don't need a Stripe account to purchase.
For the user making the purchase, nothing changes compared to similar services, such as PayPal. When making the payment, you simply use the preferred method supported by the site.
Is Stripe a secure payment method?
Stripe complies with the PCI standard, for which it has been certified Level 1. This standard is also guaranteed for companies using the service thanks to the native STRIPE.JS library. With this feature, the online store will not have to manage sensitive card data; it will be transferred to the secure Stripe server without any intermediate steps.
Mark (if applicable)
Payment for products purchased on the Site can be made by cash on delivery to the courier.
This method requires a 2% commission on the total order with a minimum of €3.00 VAT included.
Payment by cash on delivery will be available only for orders up to €1900.00 (VAT included).
Bank Transfer (if applicable)
Payment for products purchased on the Site can be made by advance bank transfer.
The order will be processed upon receipt of proof of payment via bank transfer receipt.
Otherwise, MAGIC COOKER will wait for the transfer to arrive directly into the indicated bank account.
The goods will be shipped only after the order has been accepted and payment has been received.
If an order is cancelled, either by the customer or if the seller rejects the order, the order will be cancelled and the blocked amount will be released (release times depend exclusively on the banking system). Once the transaction is cancelled, the seller cannot be held liable for any damages resulting from the release of the blocked amount by the banking system.
IV. DELIVERY METHODS
For each order placed, the seller issues a sales document for the shipped material. The invoice is issued based on the information provided by the customer at the time of ordering. The customer may request a copy of the invoice or receipt within three months of issuance.
Delivery costs are the responsibility of the customer and are indicated when placing the order.
The seller cannot be held responsible for any delays in processing or delivering the order. Upon delivery, the customer is required to check:
- that the packaging is intact, not damaged, not wet, or in any way altered;
- that the number of packages corresponds to that indicated in the transport document.
Any damage to the product or packaging, or any discrepancies in the information provided, must be immediately reported to the courier by writing "Subject to Inspection" on the courier's delivery receipt. Once the courier's delivery receipt has been signed, the customer will no longer be able to raise any objections regarding the external appearance of the goods delivered.
If the items stored at the courier's warehouse are not collected within 5 working days due to repeated failure to deliver to the address indicated by the customer when placing the order, the order will be cancelled.

APPLICABLE LAW
The sales contract between the customer and the seller is deemed to have been concluded in Italy and is governed by Italian law. Unless otherwise stated, Italian law applies.
For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the customer is a consumer, i.e., a natural person who purchases the goods for purposes not related to his or her professional activity, or does not indicate a VAT number in the order, the territorial jurisdiction is that of the relevant court of his or her municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the court of the Seller's registered office.
INFORMATION ON THE PROCESSING OF PERSONAL DATA
SUBJECT: Information and request for consent pursuant to and for the purposes of Articles 13, 23, and 26 of Legislative Decree No. 196 of June 30, 2003, regarding the protection of personal data.
The seller informs you pursuant to and for the purposes of art. 13 of Legislative Decree 196/2003 that:
The aforementioned Legislative Decree establishes a series of obligations for those who "process" (i.e., collect, record, process, store, communicate, disseminate, etc.) personal data relating to other individuals, prescribing the duty to inform interested parties of the rights recognized by law and the characteristics of the data processing;
the processing of your personal data that will be requested from you and that you will communicate to us will be carried out on the Seller's premises in compliance with the principles of necessity and relevance with the use of computerized procedures, for legal and fiscal obligations for the execution of contractual obligations;
The data controller is the seller. The data processor is domiciled for legal purposes at the company's headquarters. During such processing, the data controller and its representatives may become aware of the data, which will be processed in compliance with the obligations arising from privacy regulations and according to principles of fairness.
the processing will be carried out using manual and automated systems designed to store, manage, and transmit the data, with logic strictly related to the purposes of the processing, based on the data in our possession and with your commitment to promptly communicate any corrections, additions, and/or updates;
Excluding communications and disclosures made in compliance with legal and contractual obligations, the data provided to the undersigned will be used solely for legal compliance;
The nature of the provision is to be considered strictly necessary in relation to the purpose of the aforementioned processing. Your provision of the aforementioned data is essential for the proper performance of the activities listed above;
any refusal will make it impossible to properly fulfill contractual and legal obligations, compromising the continuation of the relationship established between the parties;
You may exercise your rights towards the data controller at any time, pursuant to art. 7 of Legislative Decree 196/03, in particular:
- know whether or not personal data concerning you exists and have them communicated to you in an intelligible form;
- be informed about the owner, the purposes and methods of processing, and any data processors, as well as the subjects or categories of subjects to whom the personal data may be disclosed;
- obtain the updating, rectification or integration of data;
- obtain the cancellation, transformation into anonymous form or blocking of the same;
- object for legitimate reasons to the processing of data, subject to the limits established by law;
- oppose the sending of advertising material or for carrying out market research or commercial communications.
